Robert Smithson, Jr. Obtains Dismissal of Criminal COVID-19 Business Closure Charges
On behalf of a large corporate client with nationwide offices, Robert E. Smithson, Jr., Esq. defended the client against a criminal obstruction charge arising from alleged violations of a Municipal Executive Order mandating business closures due to COVID-19. The charge was dismissed at the initial appearance based on Mr. Smithson’s successful argument that the local executive order was preempted by Statewide Executive Orders 107 and 108, under which the client was authorized to continue normal business operations.
