Richard is an associate in the Firm’s Secured Creditors’ Rights Litigation Group, where he is relied upon by the firm as experienced New York trial counsel to represent some of the largest lenders and loan servicers in the United States.

Overview

Richard is personally responsible for litigating highly contested residential real estate foreclosure, title curative matters, and alleged violations of the Fair Debt Act, primarily in New York, including settlement negotiations, deposition, discovery, and motion practice and oral argument in the New York State Supreme Court, the Appellate Division, and the Federal District Courts. Richard also has specialized experience representing lenders in commercial foreclosure matters and conducting cooperative apartment enforcement actions under the Uniform Commercial Code, and has represented lenders in numerous complex third party and REO closings. Richard often provides opinion and advisement in his areas of expertise to his associates and also to the most senior members of the firm.

Prior to becoming an attorney, Richard served for 10+ years in federal law enforcement, in both an investigative and supervisory role. As such, he brings a unique body of professional and legal experience to the practice of law, as well as an ability to communicate respectfully and effectively with clients, judges, court personnel, and defendants alike. An accomplished New York litigator for over 20 years, Richard has mastered the nuances and difficulties of practicing law in the New York courts, considered by many to be the most difficult practice jurisdiction in the country. He is adamant regarding file preparation and maintains a constant communication flow with clients and trial witnesses, who consider him a trusted and responsive “go-to” member of the firm. Richard believes that setting a initial well developed legal strategy, with proper execution and follow through, will lead to successful outcomes in the most difficult of matters.

Since joining the firm in 2007, Richard has appeared in court primarily in the downstate New York counties on well over 2,000 matters, from initial conferences to limited issue hearings and full-issue trials.
